“OLDEST FURNACE” CONTEST (the “Contest”)
Official Contest Rules (the “Rules”)
The Contest is sponsored by One Hour Heating & Air Conditioning (the “Sponsor”).
NO PURCHASE NECESSARY.
Void where prohibited by law.

Please read these rules in their entirety before entering the Contest.  Please do not enter the Contest unless you agree to these rules.  Participation in the Contest constitutes full and unconditional agreement and acceptance of these rules which are final on all matters relating to the Contest. 

1. HOW TO ENTER:
To enter, visit www.boonstrasonehour.com, www.mrfurnacesonehour.com, www.airqualitysonehour.com, www.21degreesonehour.com, or www.furnasmansonehour.com and click on the “Oldest Furnace Contest” link. Complete the online entry form and click on “submit”. All entries must be submitted between 9 am Eastern Standard Time on November 1, 2009 and 11 pm Eastern Standard Time on December 30, 2009 (the “Contest Period”) in order to be eligible to win a prize.

2. ELIGIBILITY:
The Contest is only open to an individual who:

  • is a legal resident of, and currently resides in the province of Ontario or Manitoba;
  • is 18 years of age or older at the time of Contest entry;
  • resides within the defined service area of a participating Sponsor branch;
  • is the legal owner and occupant of the single family home with a warm air heating system that contains the operational (providing heat to the home at the time of contest entry and winner selection) furnace submitted for entry into the contest; and
  • is not an employee of the Sponsor, or of any of its affiliates, parent companies, subsidiaries, advertising and promotion agencies, or other coordinating agencies involved in the development, implementation and distribution of the Contest, or an immediate family member or person living in the same household of such an employee.

Limit of one (1) Contest entry per eligible home during the Contest Period.

No entry fee, payment, or proof of purchase is necessary to enter the Contest. This Contest is subject to all federal, provincial and local laws and regulations.

3. PRIZE:
There will be a total of four (4) grand prizes awarded in Ontario and one (1) grand prize awarded in Manitoba, each consisting of one (1)High Efficient Gas Furnace with basic installation (each a “Grand Prize”). The approximate value of each Grand Prize is $4,588.

There will be a total of forty (40) secondary prizes awarded in Ontario and ten (10) in Manitoba, each consisting of one (1) free furnace tune-up with 12 point inspection (each a “Secondary Prize”). The approximate retail value of each Secondary Prize is $127.

4. PRIZE SUBSTITUTION:
Prizes are non-exchangeable, non-transferable, non-refundable, have no cash surrender value and must be accepted as awarded with no substitutions. The Sponsor reserves the right, in its sole discretion, to substitute and/or modify a prize with (a) prize(s) of equal or greater value for any reason with immediate effect at any time prior to the closing date of the Contest by advertising that fact.

5. PRIZE RESTRICTIONS:
The winner is solely responsible for any and all expenses which are not included in the prize descriptions above. The winner should allow ten (10) days for the delivery and installation of the Grand Prize at his/her residence. In addition, winners are responsible for any federal, provincial, and local tax consequences and for compliance with all governmental reporting and payment requirements. 

Prizes may not be exactly as shown in contest publicity or promotional materials.  All incidental costs and expenses not specifically referred to herein, including but not limited to any additional non-basic duct system modifications (if required), any hazardous material removal and abatement (e.g., asbestos) and any improvements needed to bring the Grand Prize installation in compliance with existing building and mechanical codes, or gas piping if not currently a gas furnace, shall be the sole responsibility of winner. Any costs will be disclosed by the Sponsor in writing prior to installation and will be the sole responsibility of the winner.

6. GRAND PRIZE WINNER SELECTION:

ONTARIO: One (1) eligible winner will be selected by each participating Sponsor branch from all eligible entries received based on the judging criteria outlined below, for a total of four (4) Grand Prize winners in Ontario.

MANITOBA: One (1) eligible winner will be selected by the participating Sponsor branch from all eligible entries received based on the judging criteria outlined below, for a total of one (1) Grand Prize winner in Manitoba.

7. GRAND PRIZE JUDGING CRITERIA:
The submitted furnaces will be evaluated on objective information (e.g., the furnace nameplate), installation or sale paperwork provided by the homeowner, or the best judgement of the Sponsor (whose decision shall be final in this respect) to determine which is the “oldest”.  The winning entrants will be determined on January 7, 2010 by designated representatives, as chosen by the Sponsor, at each participating Sponsor branch.  The eligible winners will be contacted by telephone and email within 24 hours of being selected.  If a selected entrant cannot be contacted within 7 days. of the initial attempt, or if contacted does not claim his/her prize, or does not meet all of the Contest conditions outlined in these Rules, another entry will be selected from all remaining eligible entries using the same criteria outlined above.  The chances of winning a Grand Prize are dependent on the total number of eligible entries received by each participating Sponsor branch and the age of furnaces submitted for selection to each participating Sponsor branch. In the unlikely event of a tie, selection of the winning furnace will be at the sole discretion of the participating Sponsor branch’s General Manager.

In order to be eligible to receive a prize, the selected entrant must correctly answer, unaided, a time-limited mathematical skill-testing question to be administered by over the phone at a pre-arranged mutually convenient time.

All selected entrants submitted furnaces will be subject to an inspection by a Sponsor designated representative (whose decision shall be final in this respect) to confirm the corresponding data provided by the entrant on the selected furnace is accurate before being declared a Grand Prize winner.

8. SECONDARY PRIZE WINNER SELECTION:

ONTARIO: Ten (10) eligible winners will be selected via random draw on by each participating Sponsor branch from among all remaining eligible entries received after the Grand Prize winner has been determined, for a total of forty (40) Secondary Prize winners in Ontario.

MANITOBA: Ten (10) eligible winners will be selected via random draw by each participating Sponsor branch from among all remaining eligible entries received after the Grand Prize winner has been determined, for a total of ten (10) Secondary Prize winners in Manitoba.

The random draws will take place on January 7, 2010 by designated representatives, as chosen by the Sponsor, at each participating Sponsor branch.  The eligible Secondary Prize winners will be contacted by telephone and email within 24 hours of being selected.  If a selected entrant cannot be contacted within 7 days. of the initial attempt, or if contacted does not claim his/her prize, or does not meet all of the Contest conditions outlined in these Rules, another entry will be selected by random draw from all remaining eligible entries.  The chances of winning a Secondary Prize are dependent on the total number of eligible entries received by each participating Sponsor branch.

9. GENERAL RULES & CONDITIONS
By participating in this Contest, entrants agree to be bound by these Rules.  Winners may be required to sign and complete a Declaration and Release (where legally permissible) and return the signed documents to the Sponsor before receiving the specified prize, otherwise the specified prize may be forfeited and awarded to an alternate entrant.  Each winner consents to the use of their name, city of residence, likeness, photograph and/or image of the winner or the old and/or new furnace without payment or compensation, in any publicity or advertising in any medium carried out by the Sponsor.  Winners agree to provide the Sponsor with monthly heating bill costs for the 12 months before and 12 months after the installation of the Grand Prize and winners consent to sharing this information with the public.  All entries become the property of the Sponsor and will not be returned. These Rules and all matters related to the Contest will be governed by the laws of the Province of Ontario, without regard to its conflict of laws principles.

10. LIMITATION OF LIABILITY:
BY ENTERING THIS CONTEST OR ACCEPTING ANY PRIZES, THE ENTRANT AGREES THAT THE SPONSOR, AND ITS PARENT, SUBSIDIARIES, AFFILIATES, DIRECTORS, OFFICERS, SHAREHOLDERS, EMPLOYEES, ADVERTISING AND PROMOTION AGENCIES INVOLVED IN THIS CONTEST SHALL HAVE NO LIABILITY AND SHALL BE HELD HARMLESS BY THE ENTRANT FOR ANY DAMAGE, LOSS OR LIABILITY TO PERSON OR PROPERTY, DUE IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, BY REASON OF ENTERING THE CONTEST, THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF ANY PRIZE, OR WHILE PREPARING FOR, PARTICIPATING IN ANY PRIZE-RELATED ACTIVITY.  Any and all claims, judgements and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event, shall include legal fees.  The Sponsor and its promotion and advertising agencies are not responsible for technical, hardware, software or telephone failures of any kind, lost or unavailable network connections, fraud, incomplete, garbled or delayed computer transmissions, whether caused by the Sponsor, users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the processing of submissions which may damage a user’s system or limit a participant’s ability to participate in the Contest.

11. TAMPERING:
If for any reason the Contest is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the reasonable control of the Sponsor that corrupts, impairs or affects the administration, security, fairness, integrity, or proper conduct of this Contest,  the Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify, extend or suspend the Contest and/or prizes.  In such event, the Sponsor may award prizes based on the criteria outlined in section 6 above from all eligible entries received up to the date of cancellation or suspension.  Sponsor further reserves the right to disqualify, from this Contest and future contests of the Sponsor, any individual who tampers with or in any way corrupts the entry process.  The Sponsor may prohibit an entrant from participating in the Contest or winning a prize if, in the Sponsor’s sole discretion, the Sponsor determines that said entrant is attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or any unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or the Sponsor representatives.

CAUTION:  ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING LAWYERS’ FEES) FROM ANY SUCH ENTRANT OR ANY OTHER INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION.

12. INFORMATION REGARDING THE ENTRANT
Certain information about entrants is required by the Sponsor to administer the Contest and to verify and contact the winners. You are under no obligation to provide this information. By completing the entry form and returning it to the Sponsor, entrants expressly consent to the Sponsor’s collection use and disclosure of this information as provided herein, or as otherwise authorized or required by law.
